My relationship has ended and my partner has left – what happens to the tenancy?
If you and your partner are joint tenants and one of you leaves, the leaving tenant is still responsible for the tenancy and the property. So, if there are rent arrears, even though one tenant is not living there, they are still responsible for paying the rent and arrears. If the leaving tenant ends the tenancy by giving 4 weeks notice in writing, the tenancy will come to an end for both tenants. The remaining tenant may not be allowed to remain in the property. This will depend on the size of the property, the size of the household and whether there have been any problems with the tenancy.
